Court Dismisses Employee Complaint Against DirecTV

A California Superior Court judge dismissed a case filed against DirecTV concerning a former employee in the company's end user development group.

The judge presiding over the case granted DirecTV's motion to strike the complaint under California's "anti-SLAPP" statute, designed to protect the right to petition government by providing a vehicle for early dismissal of lawsuits aimed at interfering with the exercise of that right. The case involved John Fisher, a former employee pursuing a wrongful termination claim against the company.

Fisher and his attorney Jeffrey Wilens have agreed to arbitrate the wrongful termination claim. The focus of Fisher's concerns was with DirecTV's end user litigation program targeting those allegedly stealing service.

Wilens said he and his client intend to appeal unless a settlement is reached. Wilens said the arbitration will still go forward unless the case is settled.

The attorney also commented about the litigation and DirecTV's efforts to target end users allegedly stealing service. "So far, no California appellate level court has addressed this question whether it is proper to send out 100,000 form letters making false accusations. That day may come," Wilens said.
