OCEANSIDE: Local businessman gets 18 months for scheme
An Oceanside businessman who hired computer hackers to break the DISH Network's encryption signal so a line of satellite receiver boxes his company sold would still have a market was sentenced Friday to federal custody.
Jung Kwak, also known as "Mr. Viewsat," was sentenced to 18 months in custody, according to the U.S. Attorney's offices in San Diego.
His two admitted co-conspirators, Phillip Allison and Robert Ward, both of Florida, were each given a month in custody, followed by five months of house arrest.
All three defendants pleaded guilty Oct. 23 to one count of conspiracy to violate the Digital Millennium Copyright Act.
The defendants admitted that, beginning in March 2008, they decided to hire computer hackers to break DISH's encryption scheme, known as Nagra 3, so that satellite receiver boxes sold by Kwak would still be viable.
Kwak, 33, owned and operated Viewtech Inc. in Oceanside, which imported free-to-air satellite receiver boxes and sold them to the public through retailers.
There is nothing noted on the docket yet so I'll check on Monday to try to make sure its accurate. They were still going through pre sentence reports and Kwak had filled an objection so was not expecting an official sentence for a couple of months but maybe something happened and he dropped the objection motion. This was basically what the plea agreement was calling for.
