Echo is filing a motion for summary judgment against TDG meaning they are asking the court for a judgment without a trial basically claiming there is no need for one because of the evidence. TDG will have to file against it.

Here is the motion filed by Echo against Ward seeking sumarry judgment. I have attached also part of a declaration by Rogers in support of it. There are seven parts to it and I might get more but think what I have posted gives you the picture and the rest missing is probably more evidence of posts.

Here is the response by Ward to the motion for sumarry judgment. Ward concedes its illegal under the DMCA to post files for distribution but says it might not be him as several people had access to his computer.


In fact he offers that it might be his son who is responsible for the posting of files.

Here is the response plus affidavit to the above. In it is the the plea arrangement sought but not yet approved in the Criminal Case for Ward ( TDG ) It is in the Frank declaration file.

In response to the motion for sumarry judgment supplied by Ward's lawyer the Judge as requested Echo to resond on the issue regarding if the law should consider software as being a device.


I have attached that order along with the brief that Echo submitted in complying with that order.

The Rogers evidence against Ward shows that you and Ward have a history. Do you want to explain what that is all about?

He does seem like a flaky guy and might be a little too lunchy to know how much trouble he is in.

We don't get along. I could go on with getting into details from my side but hes not here to give his or could be restricted from posting about certain things with his lawyer's advice so for now will just leave it like that. He obviously has his hands full with his legal problems.

to briefly sum it up without pointing the, who's wrong or right, finger.
after viewsat was first sued in 2007 by dish, ward posted what he thought or was told to, stating the frivolous nature of the suit and that dish stood very little chance and things like that, GS2 did not agree with him and posted why he thought that and the argument started from there and as usual with long arguments it expanded to encompass many other unrelated things.
thats about it in a nutshell
