A decision was reached on whether Steve Rodgers should go back to Jail for not. The judge had to decide if he had purged his original contempt. The Judge decided he had thus no further punishment was issued.


Rodgers handed over passwords to the servers that he said before that he had no control over. However the Plaintiffs alleged most of data from the servers was erased 24 hours before turning over the passwords to them and gaining access. Further to that the plaintiffs provided compelling evidence that Mr Rodgers was responsible for wiping clean the data.


However the Judge concluded that this new allegation was not part of the scope of the original contempt so he could not consider it. Plaintiffs can choose to file a new motion for contempt based on their lastest allegations. I see he is represented by new counsel Alan Gold. He is a very good lawyer. There is another lawyer but I do not know him.


If Mr. Rodgers has deliberately destroyed the very evidence the Anton
Piller order required him to preserve that would be a serious, contemptuous action,
warranting serious sanctions. That issue, however, has not been the subject matter of
a motion for a finding of contempt.
